Meet Ricardo Contreras, who thanks to Ted Kennedy, John McCain and others, could be applying for a Z Visa soon.

Immigration and Custom Enforcement officials say Contreras is in the country illegally, and that he had been picked up by ICE officials in California and deported twice in April of 2004.

Thus far today, by a 46-51 margin, the Senate has rejected an amendment that, if adopted, would have likely dealt a severe blow to the already fractious coalition supporting the so-called "Grand Bargain." Although SA 1184, sponsored by Sen. Cornyn, would have simply expanded the list of crimes making illegal aliens ineligible for legalization, opponents claimed that its intent was to make the vast majority of illegal aliens ineligible for legalization. The amendment did not, by definition, apply to an individual who entered or re-entered the country illegally. It would have applied only to those individuals who have been arrested, charged, convicted and sentenced by a court of law to one year or more in jail. Moreover, it would have targeted only those who have repeatedly been convicted of criminal offenses and are considered felons under current law. Before Senators voted down the Cornyn amendment, Sen. Ted Kennedy (D-Mass.), long an open-borders advocate and one of the prime movers behind the "Grand Bargain," offered a more lenient counterproposal to Cornyn's amendment (SA 1333). The text of this amendment was unavailable until just before a vote on it was taken; nevertheless, Senators approved the Kennedy amendment by more than a two-to-one margin (66-32).
Cornyn's bill would deny Z Visas to aliens already deported:
Cornyn SA 1184 (for himself and Sens. Ben Nelson and DeMint): Permanently bars from admission into the United States, and denies immigration benefits (including legal status under the amnesty in this bill), to: (1) absconders (i.e., aliens already ordered deported); (2) aliens deemed inadmissible or deportable as security risks (e.g., terrorists); (3) aliens who fail to register as sex offenders; (4) aliens convicted of certain firearms offenses; (5) aliens convicted of domestic violence, stalking, crimes against children, or violation of protection orders; (6) alien gang members; and (7) aliens convicted of at least three DUIs.
Contreras was deported twice. And he's still here and 54 year old George Smith is dead:
State Troopers say he was driving while impaired and crossed the median on I-40, slamming into two cars.
The driver of one of those two cars, 54-yea-old George Smith of Cary died at the scene.Prosecutors say Contreras could face more charges. State Troopers say the SUV he was driving was stolen from the Charlotte area.
Then there's this from the article:
The percentage of Hispanics arrested for drunken driving is much higher than their population percentage.
This is not surprising. What's the solution?
Hispanic advocates say more education is needed.
More education? How about MORE DEPORTATION? If this criminal had been deported, as he should have been, George Smith would be alive today. Does Ted Kennedy care? NO. HE. DOES. NOT.

Kennedy has now offered his counter-amendment, 1333.
Kennedy: "What is an amnesty? 1986 was an amnesty. This is not an amnesty. There were enforcement provisions in there, but they were completely inadequate. We had Republican presidents. They didn't enforce it. (Raising voice) And they're the great defenders of the border?! I mean, please. All those years we had enforcement [in the law] and they did not [enforce]."
Uh, exactly.
Kennedy continues: "We have immigration reform that is strong, practical, and fair. Bring 12 million out of the shadows, into the sunlight. We're not going to conduct massive round-ups. No means to do it. Inflict hardships. Cost more than $250 billion. Buses."
Blahblahblah.
Kennedy: "The Cornyn amendment would make vast numbers of these families ineligible. It would keep them in the shadows. It hurts the immigrants and Americans. Cornyn amendment classifies "garden variety" violations as crimes."
Yes, Kennedy considers ignoring deportation orders as a garden variety crime.
Kennedy also says that using false ID is a garden variety crime that shouldn't disqualify Z visa applicants.
Kennedy claims his amendment bans gang members, drunk drivers, sexual offenders, perjurers, frauds.
10:21am Eastern. Kennedy claims Cornyn would bar legitimate refugees who were forced to provide material support for terrorists, oppressor groups. Pouring it on: "The door to freedom of America would be closed shut."
Another anecdote about an illegal alien "juvenile delinquent" who Kennedy says deserves a Z visa.
So, Kennedy has just ranted about how he won't let criminals get Z visas...and then argues for endless waivers to "retain a level of discretion in our immigration laws....This is the crux of the difference between Cornyn's amendment and ours..."
Yeah: Cornyn means it. Kennedy doesn't.
